You must be at least 18 years old to create an account and purchase a membership on your own behalf. Athletes under 18 may only participate when a parent or legal guardian creates the account, agrees to these Terms on the minor's behalf, and provides verifiable consent. Parents/guardians are responsible for monitoring their child's use of the Services.

Memberships are offered on a recurring basis (monthly, annual, or as otherwise stated at checkout). By purchasing a membership, you authorize us and our payment processors to charge your payment method on a recurring basis at the then-current rate until you cancel.

• Recurring billing continues automatically until canceled by you.
• Pricing, features, and program contents may change with reasonable notice.
• Promotional rates apply only to the introductory period stated at checkout.
• Taxes and currency conversion fees may apply based on your location.

You may cancel a recurring membership at any time through your account settings or by contacting us. Cancellation stops future renewals; access continues until the end of the current paid billing period. We do not provide prorated refunds for partial months or years. The Services may include digital products (videos, courses, downloads), live and recorded content, group coaching, one-on-one coaching, mentorship sessions, events, and live calls. Specific deliverables, schedules, and access durations are described at the point of purchase or in a separate coaching agreement.

• Digital products are licensed to you for personal, non-commercial use only.
• Recorded content may not be downloaded, redistributed, or resold without written permission.
• Coaching and mentorship are educational and motivational in nature — not medical, psychological, financial, or legal advice.
• Annual coaching engagements are governed by a separate signed coaching agreement that prevails over inconsistent terms.

The S.M.I.L.E. Zone makes no guarantees or warranties, express or implied, regarding athletic, academic, recruiting, scholarship, or professional outcomes. Outcomes depend on many factors outside of our control, including individual effort, skill, health, opportunity, and circumstance.

Without limiting the foregoing, we expressly disclaim any guarantee of:

• Athletic success or improvement.
• College scholarships or recruiting opportunities.
• Playing time, roster spots, or coaching decisions.
• Draft selection or professional baseball opportunities.
• Specific results from coaching, mentorship, or community participation.

You agree to use the Services lawfully and respectfully. You will not:

• Harass, bully, threaten, or harm any member, coach, mentor, or staff member.
• Post hateful, discriminatory, defamatory, sexually explicit, or otherwise inappropriate content.
• Solicit, recruit, or market competing products or services to our members.
• Impersonate any person or misrepresent your affiliation.
• Attempt to gain unauthorized access to any account, server, or system.
• Share, scrape, or redistribute member-only content or community discussions.

All training materials, videos, written content, branding, logos, and curriculum are owned by The S.M.I.L.E. Zone or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to access and use the Services for your own development.

You retain ownership of content you post. By posting in the community, you grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content as needed to operate and promote the Services.

We reserve the right to suspend or terminate your account, with or without notice, for any violation of these Terms, the Community Guidelines, or conduct we determine, in our sole discretion, is harmful to other members, our staff, or the platform. Termination for cause is not eligible for a refund.

To the maximum extent permitted by law, The S.M.I.L.E. Zone, Jay Jackson, our coaches, mentors, employees, contractors, affiliates, and partners shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, data, business, goodwill, or opportunity, arising out of or related to your use of the Services.

Our total aggregate liability for any claim relating to the Services is limited to the amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. See our Disclaimer.

Baseball training and athletic participation involve inherent physical risks. You (and, for minors, the parent or guardian) acknowledge and voluntarily assume those risks. You are solely responsible for consulting a qualified physician before beginning any physical training program.

You and The S.M.I.L.E. Zone agree to attempt to resolve any dispute informally first by contacting us. If we cannot resolve a dispute within sixty (60) days, the dispute shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

Class action waiver: Disputes must be brought on an individual basis only and not as a plaintiff or class member in any purported class, collective, or representative action.

This section does not prevent either party from seeking injunctive or equitable relief in court for intellectual-property infringement or similar claims.

These Terms are governed by the laws of the State in which The S.M.I.L.E. Zone is headquartered, without regard to conflict-of-laws principles. Subject to the arbitration clause above, you consent to the exclusive jurisdiction of the state and federal courts located in that State.

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
